Activision files countersuit against No Doubt over Band Hero

Activision, the maker of music video game Band Hero, has filed a countersuit against No Doubt in response to the band’s lawsuit. Last month, the band filed suit against Activision over the use of No Doubt members’ likenesses being playable avatars for other bands’ songs. We covered the incident in a web-exclusive cover story on Nov. 16.

Now Activision are returning the favor with a lawsuit of their own against No Doubt, citing breach of contract and unjust enrichment. The company made the following statement: "Activision admits that although it is possible to program a videogame whereby particular in-game characters can only be selected when certain songs are played, Plaintiff first requested this only after the Band Hero programming was finalized, had been submitted to all of the U.S. console manufacturers for approval and had been approved for manufacture by most console manufacturers…"

Activision is suing for unspecified damages along with a return of all of No Doubt’s benefits and payments stemming from the game.
