On May 10, both Silva and La Barrie were involved in a car crashIt was reported that the two were driving drunk on La Barrie’s 25th birthday and crashed into a street sign and tree. Following the crash, police were called to the scene of an accident. La Barrie was pronounced dead at the hospital soon after.

According to the LAPD, “a 2020 McLaren 600LT was traveling eastbound on Huston Street at a high rate of speed when the driver lost control. [The] driver then ran off the road and collided with a stop sign and a tree on the northeast corner of Huston Street and Carpenter Avenue. No other vehicles were involved in the collision.”

Silva was originally charged for one count of second-degree murder to which he pled not guilty. At the time of his arraignment, prosecutors said Silva could face a maximum sentence of 15 years to life in state prison.

However, back in July, Silva reached a plea deal. According to the Los Angeles County District Attorney’s Office, Silva entered a no-contest plea deal to one felony count of vehicular manslaughter with gross negligence. As part of the plea deal, prosecutors agreed to drop the second-degree murder charge.

Now, sentencing for Silva is complete. On Tuesday, Silva was sentenced to 4 years in state prison. However, that sentence is suspended. He will serve 365 days in county jail with 216 days of credit. Silva is also getting 5 years of probation and 250 hours of community service.

Following the sentencing, his attorney Mike Cavalluzzi spoke with TMZ.

“Daniel believes the sentence is fair, and in serving the probation there is a chance the charge can be reduced to a misdemeanor in the future,” he says. “It’s important to Daniel to work with Corey’s family to make sure the memory of his friend is never forgotten.”

Silva allegedly tried to flee the scene of the accident but was quickly stopped by witnesses. He was then flown to a hospital after suffering a broken hip in the crash. La Barrie’s cause of death was listed as multiple blunt force injuries.

Along with the case, La Barrie’s parents have also filed a lawsuit against Silva.

As reported by ET, La Barrie’s parents are suing Silva and his tattoo company for compensatory damages, costs of suit and pre-judgment and post-judgment interest as well as any fair and equitable relief.

The lawsuit claims that Silva was “driving the vehicle at an extremely high speed unreasonable for the condition and in violation of California law,” and that he “failed to use reasonable care” while driving the vehicle. They also allege that he was “intoxicated by alcohol and/or other unknown substances.”
